General Terms and Conditions (GTC) of CHÂTEAU ANDRÉ ZILTENER SA

for the sale of wine at trade fairs, in online shops, or by telephone

General
These GTC apply to the sale of wine at trade fairs, in online shops, or by telephone. They shall be deemed to have been accepted when the order form is signed at trade fairs, the order is submitted via the online shop, or when an oral contract is concluded by telephone. The GTC apply to all countries in which the company sells wine. We reserve the right to make changes to the range, vintage, and prices. We are unable to provide a delivery guarantee. By way of his signature the buyer confirms that he is over the age of 18.

Prices/Payment Terms
All prices are net, inclusive of customs duty and VAT (for commercial customers with special prices exclusive of VAT). Invoices are issued in local currency. No discounts or other deductions are recognized. As means of payment we accept cash, bank and postal transfers, or credit cards (Visa or MasterCard). First orders placed via the online shop must be paid for by credit card (Visa or MasterCard). Existing customers (with login) can also arrange to pay by invoice. The goods remain the property of the company until the invoice has been paid in full.

Delivery/Transport
Delivery usually takes place within 20 working days after receipt of the order by VinoLog (Switzerland), German Post (Germany), or parcel service (Austria). The customer shall be informed immediately in the event of any delays. In the event of delivery problems the company’s customer service must be contacted immediately. Delivery is free on orders over CHF 300.00 or EUR 220.00. A delivery charge of CHF 17.50 or EUR 10.90 applies to orders below this amount and to mixed boxes with several varieties (except special offers).

Warranty/Exchange
The company warrants that the wines supplied are of the best quality. The condition of the delivery received must be checked immediately upon receipt. Deliveries that are not contested in writing within 7 days of receipt shall be deemed approved. Faulty wines (e.g. cork-tainted, etc.) shall be replaced within a maximum period of 24 months after delivery providing they have been properly stored and handled. Any replacement shall always be in the form of wine. However, the company is authorized to supply another wine of the same quality as a result of fluctuations in range, vintage, price, or stock. No cash repayments shall be made.

Revocation Right
The customer’s attention is drawn to the fact that for trade-fair purchases and purchases in online shops there is no right of revocation (Article 40c Swiss Code of Obligations [OR]). In the case of sales by telephone where the order exceeds CHF 100.00, private customers are entitled to cancel the contract in writing to the company within 7 days after signing the contract. In such cases, goods that have already been delivered must be returned by the buyer to the company in perfect condition and in their original packaging. The buyer shall bear the costs of returning the goods.

Data Protection
Customer data shall be treated confidentially and neither passed on to third parties nor used or sold for the purpose of third-party advertising. The data collected shall be used solely to process the order and for customer service.

Applicable Law/Jurisdiction
All deliveries are subject to Swiss law, excluding conflicts of law and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Arlesheim/Basel-Landschaft (Switzerland).
